What should I do if I am appointed as the executor or administrator of an estate?
With respect to a potential wrongful death case, if you have any knowledge that the death was a result of an accident, omission, negligence or intentional conduct you, as a fiduciary, must consult with a wrongful death attorney. Your fiduciary responsibility to the estate includes exploring all reasonable avenues to recover money for the estate. Do I have to open an estate?
If a wrongful death case is pursued, the answer is yes. Connecticut law requires it. However, you may consult with a wrongful death attorney before the estate has been opened. A representative of the estate will be named as the plaintiff in the law suit. We will assist in opening the estate and seeing the appropriate family member appointed as administrator of the estate. That person will cooperate with our office to put the case together. This means obtaining records, signing authorizations, assisting with gathering photos, videos and documents to help explain the deceased to the insurance company representative. In cases where a minor is involved, the estate is obligated to obtain probate court approval of the settlement.
